Agreement to Terms
These Terms of Service ("Terms") govern your use of the North Coast Health Studio LLC website located at northcoasthealthstudio.com (the "Site") and the health coaching, training, and related services (collectively, the "Services") provided by North Coast Health Studio ("we," "us," or "our").
By accessing the Site or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access the Site or use our Services.
Eligibility
You must be at least 18 years of age to use our services without the consent of a parent or guardian. If under the age of 18, you must have the consent of a parent or guardian to begin coaching. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Services Description
North Coast Health Studio provides health and performance coaching services, including but not limited to:
Personal training (in-person and virtual)
Health & wellness optimization coaching
Nutrition coaching
Metabolic and performance assessments
Custom programming and guidance
Sport-Specific Training/Conditioning
Corrective Exercises, Muscular Imbalance Work, Postural Correction

Not Medical Advice: Our Services are designed for generally healthy individuals seeking performance optimization and wellness support. Our Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. We are not physicians, and our Services do not constitute medical advice.
Not a Substitute for Medical Care: You should consult with a qualified healthcare provider before beginning any fitness or nutrition program, especially if you have any pre-existing medical conditions, injuries, or concerns. Never disregard professional medical advice or delay seeking it because of information provided through our Services.
Nutrition Coaching: Our nutrition coaching provides general education and guidance based on whole food principles and evidence-based practices. We are not Registered Dietitians, and our nutrition services do not constitute medical nutrition therapy. For medical nutrition therapy or treatment of medical conditions through diet, please consult a Registered Dietitian or physician.
Results Not Guaranteed: Individual results may vary. We cannot guarantee specific outcomes, weight loss, performance improvements, or other results from our Services.
Client Responsibilities
By enrolling in our Services, you agree to:
Health Screening: Complete a thorough health history questionnaire and disclose any medical conditions, injuries, medications, or other relevant health information.
Medical Clearance: Obtain clearance from your physician before beginning our Services if you have any medical conditions, injuries, or concerns.
Honest Communication: Provide accurate and complete information about your health, fitness level, goals, and any changes in your condition during the course of our Services.
Follow Instructions: Follow the training and nutrition guidelines provided, use proper form and technique during exercises, and notify us immediately if you experience pain, discomfort, or adverse reactions.
Assumption of Risk: Understand that physical exercise and dietary changes involve inherent risks, including but not limited to injury, illness, or adverse health effects. You voluntarily assume all such risks.
Not Share Programs: Programs and materials provided to you are for your personal use only and may not be shared, distributed, or reproduced without our written consent.
Release of Liability and Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE, WAIVE, AND DISCHARGE North Coast Health Studio LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO:
Any injury, illness, or adverse health effect resulting from your participation in our Services
Any loss or damage to personal property
Any errors or omissions in the information or guidance provided
Your failure to follow instructions or disclose relevant health information
You acknowledge that this waiver applies even if the injury or damage was caused in whole or in part by the negligence of North Coast Health Studio LLC, except where such waiver is prohibited by law.
Payment and Fees
Pricing: Current pricing for our Services is available upon request and may be updated at any time. Prices are displayed on our unlisted Services page provided after initial consultation.
Payment: Payment is required in full prior to the commencement of Services unless otherwise agreed in writing. For programs over $10,000, payment plans may be available.
Payment Methods: We accept payment by credit card, debit card, bank transfer, or other methods as agreed upon.
Late Payments: If you choose a payment plan and fail to make a scheduled payment, we reserve the right to suspend Services until payment is received. Late payments may incur additional fees.
No Refunds: All sales are final. Services are non-refundable once commenced. If you choose to discontinue Services for any reason, you will not be entitled to a refund for unused sessions or remaining program time.
Exceptions: Refunds may be considered on a case-by-case basis in extraordinary circumstances (e.g., serious injury or illness preventing participation, relocation) at our sole discretion.
Cancellation and Rescheduling
Client Cancellation: You may cancel or reschedule a scheduled session with at least 24 hours' notice. Cancellations or reschedule requests made with less than 24 hours' notice will result in forfeiture of that session (no refund or makeup session).
No-Shows: If you fail to appear for a scheduled session without prior notice, that session will be forfeited.
Our Cancellation: We reserve the right to cancel or reschedule sessions due to illness, emergency, or other unforeseen circumstances. In such cases, we will provide as much notice as possible and reschedule at no additional charge.
Program Expiration
Training session packages expire 6 months from the date of purchase unless otherwise specified. Coaching programs must be used within the designated program timeframe (e.g., 3-month or 6-month programs). Unused sessions or time cannot be refunded, transferred, or extended beyond the expiration date except in extraordinary circumstances at our sole discretion.
Intellectual Property
All content on the Site and provided through our Services, including but not limited to text, graphics, logos, images, training programs, nutrition protocols, and other materials (the "Content"), is the property of North Coast Health Studio LLC and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use the Content without our prior written permission. Training programs and materials provided to you are licensed for your personal use only.
User Content and Testimonials
If you provide us with feedback, testimonials, progress photos, or other content ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and display such User Content for promotional and marketing purposes.
You represent and warrant that you own or have the necessary rights to provide such User Content and that its use by us will not violate any third-party rights.
We reserve the right to use your name, likeness, and results (including before/after photos if provided) in our marketing materials unless you specifically opt out in writing.
Privacy
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
Communications
By using our Services, you consent to receive communications from us via email, text message, phone, or other means. These communications may include:
Service-related messages (e.g., appointment reminders, program updates)
Check-ins, accountability messages, and coaching support
Administrative notices
Promotional materials (you may opt out of promotional communications)
You are responsible for providing accurate contact information and notifying us of any changes.
Termination
By You: You may terminate your participation in our Services at any time by providing written notice. However, you will not be entitled to a refund for any prepaid fees or unused sessions.
By Us: We reserve the right to terminate or suspend your access to our Services at any time, with or without cause, including but not limited to:
Violation of these Terms
Failure to pay fees
Providing false or misleading information
Behavior that is disruptive, abusive, or disrespectful
Non-compliance with program guidelines
Upon termination, you must immediately cease using any materials or programs provided to you, and no refund will be issued.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
NORTH COAST HEALTH STUDIO LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US FOR SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless North Coast Health Studio LLC its owners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
Your use of our Services
Your violation of these Terms
Your violation of any third-party rights
Any injury, illness, or damage resulting from your participation in our Services
Disclaimer of Warranties
OUR SERVICES AND SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
Our Services will meet your expectations or achieve specific results
Our Services will be uninterrupted, timely, secure, or error-free
Any information or content provided is accurate, reliable, or complete
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles.
Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or in the state or federal courts located in Illinois, and you consent to the exclusive jurisdiction of such courts.
Class Action Waiver: You agree to resolve any disputes with us on an individual basis and waive your right to participate in any class action or representative proceeding.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and North Coast Health Studio LLC regarding your use of our Services and supersede all prior agreements, understandings, or representations.
Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Site with a new "Last Updated" date. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
